Terms of Sale
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Despatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or unforeseen circumstances for which we will not be responsible. Please see our Delivery information section for further details.
In order to place orders with Moobarb, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Moobarb retains the right to refuse any request made by you, and Moobarb reserves the right to close your account with us at its sole discretion. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. Please be aware that some of the goods sold through our Websites may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.
Order Acceptance
If we accept your order, we will send you a confirmation of this by email. The receipt of an email order confirmation by you constitutes our acceptance of an order and the conclusion of a contract between us to sell the goods you have ordered, subject to these terms. Whereas, following such acceptance, Moobarb will always seek to meet the requirements of your order, there may be circumstances following confirmation where we are unable to ship products due to unavailability (of which we were not aware at the time of confirmation of the order) . If that is the case, we will notify you as soon as possible and will refund the money for the unavailable products back onto your card or into your account. If the payment process has not begun at that time, the money for such products will not be taken out of your account or from your card. However, this will only be in rare circumstances, as Moobarb only accepts orders against live stocks that are currently in our distribution centre. We do not allow orders to be placed against stock that has not yet reached our distribution centre. Moobarb's acceptance is therefore subject to the availability of products following the receipt of the confirmation email by you. Equally, while Moobarb endeavours not to make any errors on its website and to ensure that its descriptions, details and dimensions of its products, its prices and other information about Moobarb or its products, are accurate and up to date, errors can occasionally occur. If we identify an error that materially impacts your confirmed order, we will notify you as soon as possible and will provide you with the option of cancelling your order in full or the part(s) of your order affected by the misinformation. If you make such a cancellation, the money for the cancelled part of your order will be refunded to your account or onto your card (or will not be taken at all if the payment process has not begun at that time). This in no way restricts or limits your ability to return the goods in line with our returns policy. Moobarb reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Payment will not be taken, or will be refunded, for any refused orders. Your account may also be restricted or terminated for any reason, at Moobarb's sole discretion, in the event that you have breached these Terms of Use or any other policy or terms of use relating to the Site or if you have otherwise misused the Site. Verification of certain information may be required prior to the acceptance of any order. An order may not be accepted if such information is not forthcoming from you following such a request. Prices and availability of products on the Site are subject to change without notice. Errors will be corrected when discovered, and Moobarb reserves the right to revoke any stated offer and to correct any errors, inaccuracies, or omissions (including after an order has been submitted).
Pricing & Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If we cancel and you have already paid for the goods, you will receive a full refund including any paid postage. All our prices are displayed inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly shown where applicable and are included in the 'Total Cost'.
The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
Payment
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be despatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted. If in the very unlikely event that we are unable to fulfil your order or part of your order, we will credit the appropriate value back to the card/account you used to place the order as soon as this becomes apparent.
We also accept payment via PayPal. Goods will not be despatched until PayPal has confirmed funds have been received.
Complaints
At Moobarb, we pride ourselves on giving you both an excellent customer experience, and providing fantastic products to your door. We expect our suppliers to consistently provide an environment which protects their employees' health and safety and basic human rights. Moobarb will never knowingly source stock from countries which are in breach of the above principles.
